  <dc:description>Disposition and assignation granted at Muchall by Andrew. Lord Fraser, as assignee to ward and marriage of Simon Fraser, now of Inverallochy, and donator to his single and liferent escheat. See 222 supra. Letters of gift by crown granted to Sir Wm. Purvis, bart., solicitor for Scotland had included donatory of ward and nonentries &amp; marriage of lands of the late Sir Simon Fraser of Inverallochy (grandfather of Simon Fraser now of Inverallochy) assigned on 4 Jan. 1666 to Lord Fraser. The crown had granted an [?earlier] similar deed of gift to Sir Mungo Murray, which was assigned on 4 Sept. 1663 to James Kennedy, Aberdeen Town Clerk, and translated by him on 1 Feb 1665 to Hugh Dallas, commissary clerk of Ross, who went to law with Inverallochy for payment ? on 20,000 merks and 40,000 merks, but session preferred second donation (to Purvis) to the first and thence Lord Fraser, provided Simon Fraser paid Dallas 5000 merks, and in letters of gift of 5 January 1667 the king had granted to Lord Fraser escheat of estate of Simon Fraser when put to the horn. There were various legal actions thereafter by Lord Fraser. Now Thomas Fraser in Cairned....... with consent of Simon F. had paid Lord Fraser a sum of money, for which he transferred to Thomas Fraser his rights in deeds of gift of ward, etc. and in liferent escheat of certain of Simon Fraser's lands, including Inverallochy, Cairinglass and Carness, in so far as these extend under the compass of waird and liferent escheat and all right to single escheat, "but prejudice" to assignation rights of John Forbes of Culloden granted by Fraser in Fraser's escheat rights in barony of Kinkell Fraser, etc. Lord Fraser had aslo burdened Thomas Fraser and all by which he might benefit with back bond of 27 Feb. 1667 granted by Lord Fraser to John, Earl of Rothes, and others, promising that any profit obtained from gift will be used according to their advice. Includes procuratory of registration. Duly signed, Simon Fraser of Inverallochy consenting, and witnessed by Alex. Forbes of ?Ardough, John Forbes of Aslune, Hugh Dallas, commissary clerk of Ross and William Cumming, N.P.
