  <dc:description>Extract by George Hay, Clerk Register, from boooks of Council and Session of proceedings in action of declarator following on lettters of horning etc. decerned in favour of Duncan Forbes (of  Lethendie) as donator against Robert Fraser for payment of £10,000 Sc. "addebted be him" to sir Alex. Fraser  of Fraserburgh when Sir Alex. was put to the horn as in escheat disponed by the Crown in favour of duncan Forbes as in letters of gift [of 31 November 1620 (see 111).
Reference is also made to contract of 4 May 1619, registered on 6 Jan 1621 and  Simon, Lord Fraser of Lovat is also involved. Various endorsements style this MS. as Forbes against Phillorth, Old refs. 15, 66, (15). Also involves Robert Fraser, fiar of Cairnbulg and Thomas Giffurde and Sir Alexander Fraser. When first examined 10/8b was found to have top right hand corner of 13 lines missing which were eventually discovered as fragments marked as 11/15 which was then attached to the MS. of which it is part. c.f. 89 above.</dc:description>
