The estate is entailed to future heirs male of his body (if any) [thereby excluding son of his first marriage who was "fatuous"], to his daughter Mary (by his deceased second wife, Anne Forbes) and her heirs, whom failing to nephews and nieces and their descendants (details too lengthy to summarise).Lands mentioned include Craigmiln of Pittodrie, Dorlethem, Drumdurnah, Pittodrie, Harthill, Torries, Kirktown of Oyne, Old Harthill, Nethercarden, Conglass, Pitscurrie, Balhagartie, superiority of Wartle, etc. Any heirs are obliged to assume the name of Erskine and arms of the family of Pittodrie. Restrictions laid down regarding the length of tacks, etc., redemption of adjudications, ways in which right to succeed my be forfeit, liferent rights for husbands or wives in lieu of tierce (manor place of Pittodrie with parks, etc. always being reserved to heir of entail), provision for younger children.
