| Description | Disposition granted at St. Andrews and Edinburgh by David Falconer, and his curator, John Falconer in favour of John, Earl of Mar. David Falconer, styled as the only son and heir in general served and retoured to deceased John Falconer of Balmashanier, his father,, and his curator, John Falconer[Hiltonhill], advocate, executor, testamentar of late John Falconer. Disposition concerns negotiations following on granting of bond on Aug. 3 1682 by deceased Charles , Eark of Mar to the late John Wemys, brother of David Wemys of Fingask for 1000 merks. John Wemys had died in 1683 leaving numeroud debts including to deceased John Falconer (?his nephew?) one since 1676 of 1000 merks plus outstanding interest debts including to deceased John Falconer (?his nephew). )ne since 15 June of 1000 merks plus outstanding interest & others in which he had a claim, including debt of lst Earl of Mar who granted bond of corroboration on 22 Apr 1684 to late John Falconer who assignedit to Thomas Lundie of Glaswall on July, 1690. Lundie had instituted proceedings against John, Earl of Mar to enter heir to his father etc.(as in 260 q.v.), Lundie by his disposition etc of 4 Nov. 1700 had assigned rights etc. thereby obtained to deceased John Falconer. John, Earl of Mar had paid the two Falconers certain unspecified sums in settlement, he is granted a discharge and all the rights etc. obtained by them in his lands etc are assigned to him. Deed to be ratified by David Falconer on his attaining his majority. Includesprocuratory of registration. 13 sheets in scroll in all. No refs. Witness on 5th August at St. Andrews to signature of David Falconer are Alex. Scrymgeour, Prof. of Philosophy in the Old College of St. Andrews of John Cunninghame, writer there. Witnesses on 8 August at Edinburgh to signature before John Falconer are Harie Massie, W.S. and his servitor, James Edgar, writer thereof. Appended is a note (the end of which has worn or torn away) by John Falconer on 11 Aug 1707 promising delivery of one of the writs listed (apparently missing) as soon as it came to hand. |
