| Description | Disposition granted at Dundee by Thomas Lundie (of Glasswall) in favour of John Falconer, brother of Dr David Falconer, professor of Divinity in the College of St Andrews. Charles, Earl of Mar, had granted a bond on 22 Apr, 1684 in favour of John Falconer for 2000 merks with interest of £140 Sc. for 1 3/4 years preceeding Whit. 1684 & thereafter. This was assigned by John Falconer on 1 July 1690 to Lundie. Lundie had since instituted proceedings against John now E. of Mar for recovery of this and other debts to which he had right, charging him to enter heir to his father. John, Earl of Mar had "renunced to be air" and the Lords of Council had pronounced a decreet Cognitionis Causa tantum against him in order that action of adjudication might be taken against him. Decreet of adjudication duly obtained and in the long list of lands etc. involved therein are included those belonging formerly to Lord Fraser (Stoneywood, Muchall, Milne of Salvey, patronage of kirk of Cluny, Cairnbulg etc. in barony of Phillorth etc. as in adjudication of Jean, C. of Mar (afterwards married to Andrew, Lord Fraser), Charles E. of Mar or JohnKeirie of Gogar against Charles, Lord Fraser or rights obtained by Keirie, to extent at Mart. 1691 £8380:6:8 Sc. plus expenses etc. As assignation was only granted to Lundie in trust by Falconer as in backbond by Lundie to him now cancelled & Falconer has paid share of expenses in obtaining decreets, Lundie now assigns to him all rights etc. in said decreet & adjudication as concerns this sum & in original hand, etc. returned to him.
