Description | Contract of alienation (on paper in O.Sc. - 4 sheets duly signed & witnessed) signed at Aberdeen between John Gordon of Buckie and John Hay of Crimonmogate ["Crichmonmogat"] anent Little Arnage etc. John Gordon promises to pay to Hay by Whit. next 1615, at the house of John Strachan, burgess of Aberdeen, the sum of 9000 merks, & to give him an obligation signed by Gordon as principal and cautioners from among John Gordon of Benholm, James Gordon of Knockespock. Or John Gordon of Linturk with Paul Menzies of Kinmundie & Wm. Duncan of Banff, respecting payment of 10,000 merks at Whit. 1616.
If necessary money is to be deposited with Aberdeen treasurer or dean of Guild should Hay not present himself - penalty clauses in case of non-payment, etc.
In return, Hay is to infeft Gordon & heirs in toun and lands of Little Arnage, Corshill, Quhythills and Aillhouse croft & lands called Procurator's croft, walkmiln, Milnlands etc. astricted multures etc. in parish of Ellon by charter of Alienation with precept of sasine etc. in free blench ferme for one penny Scots yearly - another charter to be held of the crown for same sum in blench ferme if required. New infeftment to be obtained of the crown in favour of Gordon after due resignation by Hay under reversion of sums paid. Clauses of warrandice against facts and deeds of late Wm. Hay, sometime of Crimondgate, father of said John, etc. by giving Gordon rights in relevant to contract between Francis Earl of Errol, Lord Hay, Great Constable of Scotland (and Elizabeth Douglas, Countess of Errol, his spouse), & late Wm. Hay dated Aberdeen, 10th May 1600, registered 18th August , 1612. Entry to commence at Lammas next. Also mention of tiendsheaves of said lands and agreed by John Hay. John Gordon take from my Lord of Kinloss such rights as he may obtain respectively tiend vicarage called the small tiends of said lands. Usual causes of relief, and re renunciations, registration etc.
Written by Wm. Paip, son of Robert Paip, advocate in Aberdeen. Witnesses: Wm. Paip, Robt. Paip, James Forbes, Master Andrew Urquhart, Wm. Barclay, advocate in Aberdeen. In signature Hay spells his patronymic "Cremonthmogatt".
On the back of the first sheet is an endorsement by Hay Duly signed & witnessed, respecting receipt from Gordon of sums of 9,000 & 10,000 merks by 1 June 1615 or 1616. |
