Morice & James Murray, advocates in Aberdeen as procurators. Contract of Excambion signed at Arnage by John Ross on 29 Aug. 1842, by Jas. Wm. Mackenzie at Banff on 16 Sept. 1842 & by Alex. McNeill & Wm. Mitchell Ellis at Edinburgh on 26 Sept. 1842 & by James Murray at Aberdeen on 27 Sept. 1842. McKenzie etc. were accepting & surviving tutors of John Turner of Turnerhall & Tipperty as in deed of nomination of Tutors by his father, John Turner, of 8 June & 5 Nov. 1832. John Turner infeft as heir and feutail in Turnerhall & Tippertie as in instrument of sasine of 10 May 1839 etc. John Ross heritable proprietor of lands and barony of Arnage as in instrument of sasine of 2 Oct. 1841 proceeding from precept furth of Chancery as heir to John Ross-Leith his father, thereafter John Leith Ross of 7 Sept. 1841.
Excambion (asked for) involved portion of lands of Blindburn separated from the rest of the entailed esate of Turnerhall by the road to Old Deer & nearly in the centre of farm of Cairndailly in estate of Arnage and straightening of marches to mutual advantage and petition made to the Sheriff on 24 Feb. 1842 accordingly. David Walker and Alex. Smith, land surveyors, Aberdeen, reported thereon on 27 July 1842, this being approved by both parties an interlocutor was granted by the sheriff agreeing to excambion on that date. There then follows terms of contract of excambion which contains procuratory of resignation & precept of sasine. |
