DescriptionExtract (by A. Primrose, Clerk Register), of discharge granted at Edinburgh on 27 Jan. 1673 by John Gordon of Buckie as registered at Edinburgh before Lords of Council and Session in March 1673 at instance of John Gordon, Wm. Broun and John Elleis. Discharge granted by John Gordon of Buckie as heir to deceased, John Gordon, sometime styled of Hiltoun and fiar of Buckie, his father, and Wm. Broun, agent for the Scottish Royal Burghs, and with consent of John Elleis, elder of ? Eliestoun, advocate.
Reference is made to bond granted by deceased John Donaldson of Hiltoun of 30 May 1638 to late John Gordon and deceased Beatrix Urquhart, his mother, and Jean Scott, his wife, for 20,000 merks - liferent rights in Hiltoun and Kinharrachie renounced by mother accordingly in favour of her husband and by Jean Scott (her liferent held in warrandice of conjunct fie of lands of |Buckie), in favour of Donaldson. John Gordon fiar of Buckie agreed that should father predecease him Beatrix Urquhart should have liferent of said 20,000 merks, and if he should die before his father and wife, Jean Scott, would have liferent thereof until her father-in-law's decease. Details are then given of various inhibitions granted against deceased John Gordon, payment of various annual rents on principal, etc., earlier bonds (e.g. one by late George, Marquis of Huntly of 31st Mar. and 1 Apr. 1619 to late Capt. Andrew Donaldson and Margaret Davidson, his wife (and on behalf of daughter, Agnes Donaldson) for 11,000 merks infeftment in liferent - one of Gordons of Buckie was a cautioner). Donaldson ? of Hiltoun, son of Agnes Donaldson, was retoured heir to Capt. Andrew Donaldson.
Repayment by deceased John Donaldson is acknowledged to have been made to creditors of John Gordon of Buckie of 11,000 merks in part payment of principal of 20,000 merks and of annual rents from decease of Beatrix Urquhart (liferentrix until 1670) and Alex. Donaldson (with consent of Broun and Elleis) had paid 9,000 merks and annualrent outstanding thereon, making 20,000 merks in all, discharge is granted accordingly - names of those signing and witnessing therein are given.
