| Description | Extract by David Laird of decreet granted on that date at Aberdeen in appearance before Thomas Sandilands of Craibstone, commissary of Aberdeen, of parties in action at the instance of Elspeth Toux (?Tough)? (or Coux,)widow and executrix of deceased Andrew Burnet, elder merchant - burgess of Aberdeen against Francis Fraser of Kinmundie as principal and Andrew , Lord Fraser, as cautioner. Burnet has set tack to Fraser on 9 Nov. 1661 , the Mains of Durris etc. - see 213- 2250 merks tack duty payable yearly with vicyual etc. Fraser owed Burnet 500 merks as part of duty for crop 1663 and the whole duty for 1664 to defender as executrix of her husband who had died in January 1665. She therefore claims 2750 merks are due her with outstanding victual and had summoned Fraser & cautioner accordingly. The commissary decerned in widow's favour and valued victual according to fiar's prices for 1664.[unable to state amount as left hand third of final part of MS is missing]. |
