| Description | Extract of decreet given at Edinburgh on above date on production of letters of horning and executions thereof by Patrick Gordon, writer, to be registered in books of council and session. Letters raised by JihnSchort, commissary of Stirling, having been granted assignation of bond in which Sir Wm. Keith of Ludquhairne, bart. as principal, and his son now Sir Wm. Keith, the late Alex. Keith of Balmure and the late Alex. Bannerman [of] Elsick as cautioners of 30 May 1634 agree to apy to the late Robt. May of Raith and Marjorie Bannerman, his wife, or her heirs or assigns after his death, 2000 merks, with 200 merks annualrent thereon while unpaid and 600 merks ex-penses, registered on 4 July 1645. John Galloway in Lipinanthe is now her husband and they had granted assignation on 16 Dec. 1646 in favour of complainer, who had raised letters for payment accordingly. Keith had obtained suspension and Alex. Bannerman had granted bond of 4 Dec. 1647 (registered on 7 Dec.) as cautioner for security for Sir William. Suspension etc. called on 19 June 1649 for immediate payment by Sir Wm. Keith, younger, and his cautioner, of principal and interest outstanding. Letters of horning of 26 June 1649 followed for apprising if necessary under the signet. Then follows execution thereof on 1 Aug and intimation at Stonehaven mercat cross on 2nd and actual putting to horn on 9th Aug. of Bannerman as cautioner. [MS. breaks off at this point]. |
