(Signed at Muchall on 5 and 29 May). Contract follows on marriage contracty at Edinburgh on 3 July 1618 betwen Lord Balmerino and his sister and the Frasers elder and younger, by which the young couple were to be infeft in conjunct fie to them and heirs male etc. in Faithfield with mill lands, Todilhill, Little Deanis, Wester Deanis, Sisoche, Invervedie in barony of ?Linden in sheriffdom of Aberdeen, held by them of William, Earl Marischal, Lord Keith & Altire, no immediate superior, by disposition or resignation to be made by Andrew Fraser, elder, in their favour. The father had also set in tack to them the tiendsheaves, rents etc. ofthese lands from their entry therein Lammas 1618 & thereafter for life for 40 shillings Sc. yearly, tiendsheaf duty, reserving to the elder his liferent of tiendsheaves of Todilhill & Little Deanes. They were also to be granted assignations to all tacks acquired of tiendsheaves etc. of above lands etc. in security for above.Margaret Elphinstone guaranteed (should her husband pre-decease her) & rent for life of 30 chalders vicyual over and above customs etc. of above lands. Now by special agreement an excambion is to be made between the parties to above contract Andrew Fraser, younger and his wife assigning above lands to his faher in return for lands at Mains of Durris with fortilice etc., Kinthounies, Balfour, Densyde, Brakmonth, Castletoun of Durris with castlehill, Pitcalltines, Strachan,(?), Meikle and Little Tulloch, Calladrum(with smiddy etc.), Wester Eschintullie (called Eschintullies regis), in barony of Durris in sheriffdom of Kincardine Wester Durris with Milltown etc, Balladrum, with right of presentation and patronage to parish of Durris- to be held by Andrew Fraser, elder, either blench or feu and of him as of immediate superior etc. etc. too lengthy to summarise further. |
