DescriptionExtract nade by Alex. Gibson of decreet of suspension granted at Edinburgh on above date in favour of Andrew Fraser of Stoneywood against John Forbes of Pitsligo.Old refs. (28), ?c.f. 119, of 15 Mar. 1621.

Following on letters of suspension at the instance of John Forbes against Andrew Fraser. Fraser had ......ised letters of horning against Forbes for sums duly assigned to Fraser by Alex. Forbes of Boyndlie for 5,000 merks for redemption of lands etc. of Kynnaldie as in contract of 11 June 1615 & interest outstanding thereon as in decreet & pain of horning. This considered to be unjust as Forbes had already paid Fraser 10,000 merks in part payment thereof & has discharge of 21 May 1621 with decreet for payment of 500 merks interest of 6 Feb. 1622 and due on Whitsunday last.
The third instalment with 250 merks interest on final instalment is due at Whitsunday & on 8 June 1622 he had duly offered 5,000 + 250 merks at parish kirk of Aberdour when it had been consigned into hands of Alex. Forbes of Boyndlie and instruments were taken and shown now in evidence,. These sums are arrested at the instance of Robert Forbes of Midtoun of Wairdis as assignee of Alex. Fraser of Bogheid in sums due by Andrew Fraser to Alex. Fraser. Suspension of letters therefore asked for. Their lordships decern that amount payable at Whit. 1623 to be 5000 principal and 250 interest and 150 making 5400 merks in all and Andrew Fraser of Stoneywood, younger, became bound to relieve Forbes of arrestments mentioned - letters raised by defender then suspended on production of sum owing and granting od discharge of this date registered the same day.
