Extract taken at Edinburgh by George Hay,clerk register of action before Lords of Council following on letters raised at the instance of John Forbes of Pitsligo against Andrew Fraser of Stoneywood and Alex Forbes of Boyndlie and also Robert Forbes of [?] Shivas or Rires. Alex. Forbes was to have been infeft in Kynnalde & tiends thereof under reversion of 20,000 merks payable in 4 instalments with 2000 merks rent during non reversion. Andrew Fraser had been assigned rights in said contract & raised letters of horning against complainer (Forbes) requesting his infeftment & also payment of 1st instalment of (5,000 merks ) of principal etc. - other charges also, too lengthy to summarise. Assignation is seemingly dated 6 Jan. 1620 & letters of arrestment raised thereon on instance of Robert Forbes of Rines against Alex Forbes of Boyndlie executed by messenger on 2 June 1620 in hands of John Forbes of Pitsligo said sum of 20,000 merks & other sums due by John Forbes to Alex. Forbes of Boyndlie until sums due to Alex. are paid. Letters raised by Fraser are therefore suspended. £6,500 (1st instal. principal + interest &[?] expenses) is to be given to Andrew Fraser out of sum of 9591 merks consigned to Andrew Fraser in action of redemption pursued at his instance against John Forbes of Pitsligo anent redeeming of Cairnbulg as in decreet of 17 Feb. 1621. Penalty of 1,000 merks not awarded to Fraser & Fraser discharged all arrestments at his instance of sums pertaining to John Forbes of Pitsligo & is to become bound as cautioner for Forbes of Boyndlie & he offers to infeft Joh Forbes of Pitsligo in lands of Bracklay Langhill & one third part of Chamertoun to be held of Fraser in feu - he holding blench of the Earl Marischal so that Forbes of Pitsligo could give the same held in feu of himself to Alex.
