Forbes, eldest son and apparent heir of John Forbes himself, according to decreet requiring them to grant renunciations in favour of Andrew Fraser respecting barony of Cairnbulg & etc as in apprising at their instance & decreet thereon as in summonds of redemption there anent. Includes part of account proceedings in the action but breals off where MS. has been torn.
5 points made for Forbes and replied to on behalf of fraser and their lordships by their interlocutor repelled the 5 alledgances, "but prejudice" to exception of action ?? for reduction.{cannot give outcome of process as MSS. is incomplete. See 296/40. |
